1. Definitions
In these Terms and Conditions:
- "Service" refers to the real estate rental advisory services provided by Selvara, including property search, tenancy risk assessment, and continuum residence management.
- "User," "You," or "Client" refers to any individual or entity engaging Selvara's services.
- "We," "Us," or "Our" refers to Selvara, the service provider.
- "Agreement" refers to these Terms and Conditions along with any service-specific agreements.
- "Property" refers to any real estate property presented, evaluated, or managed through our services.
2. Acceptance of Terms
By engaging our services, accessing our website, or communicating with Selvara, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
You must be at least 18 years of age and possess the legal capacity to enter into binding agreements. By using our services, you confirm that you meet these requirements.
3. Service Description
Selvara provides specialized real estate rental services in Singapore, including:
- Landed Property Specialist Search: Property identification, viewing coordination, and lease negotiation support
- Tenancy Risk Assessment: Comprehensive evaluation of potential rental agreements and properties
- Continuum Residence Management: Ongoing tenancy management and support services
Services are subject to availability and may be modified or discontinued at our discretion. We will provide reasonable notice of significant service changes that affect existing clients.
4. User Responsibilities
As a client of Selvara, you agree to:
- Provide accurate, complete, and current information required for service delivery
- Respond promptly to communications and requests for information
- Notify us immediately of any changes to your contact information or requirements
- Conduct property viewings and negotiations in good faith
- Comply with all applicable laws and regulations regarding property rental in Singapore
- Maintain confidentiality of sensitive information shared during service delivery
- Make timely payment for services as agreed
5. Fees and Payment
Service fees are as follows:
- Landed Property Specialist Search: SGD 350
- Tenancy Risk Assessment: SGD 600
- Continuum Residence Management: SGD 1,950 per year
Payment is due upon service commencement unless otherwise agreed in writing. We accept bank transfers and major credit cards. All fees are quoted in Singapore Dollars (SGD) and exclude applicable taxes unless stated otherwise.
Fees are non-refundable once services have commenced, except where service delivery fails to meet agreed standards due to our fault. Any refund requests must be submitted in writing within 14 days of service completion.
6. Service Limitations
You acknowledge and agree that:
- Property availability is subject to market conditions and landlord decisions beyond our control
- Our property recommendations are based on information provided by third parties, which we verify to the extent reasonably possible but cannot guarantee
- Risk assessments identify potential concerns but cannot eliminate all risks associated with property rental
- We do not guarantee successful lease negotiation outcomes or specific rental terms
- Our services constitute advisory support and do not include legal or financial advice
- We are not party to lease agreements between clients and landlords
7. Intellectual Property
All content on our website and in our service materials, including text, graphics, logos, images, and software, is the property of Selvara or its licensors and is protected by Singapore and international copyright laws.
You are granted a limited, non-exclusive, non-transferable license to access and use our website and service materials for personal, non-commercial purposes related to engaging our services. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
8. Confidentiality
Both parties agree to maintain confidentiality of sensitive information shared during the course of service delivery. This includes:
- Personal and financial information
- Property search criteria and preferences
- Negotiation strategies and lease terms
- Risk assessment findings and recommendations
Confidentiality obligations do not apply to information that is publicly available, required to be disclosed by law, or necessary to disclose for legitimate service delivery purposes with your prior consent.
9. Disclaimers
Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law:
- We make no warranties, express or implied, regarding service availability, accuracy, or fitness for particular purposes
- We do not guarantee specific outcomes or results from using our services
- We are not responsible for actions or decisions made by landlords, property owners, or third parties
- Information provided about properties is believed to be accurate but is not guaranteed
- Market conditions and property availability can change without notice
10. Limitation of Liability
To the maximum extent permitted by Singapore law, Selvara's liability for any claims arising from our services is limited to the fees paid for the specific service that gave rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or business interruption, even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless Selvara, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of our services, violation of these terms, or infringement of any third-party rights.
12. Termination
Either party may terminate the service agreement with 14 days written notice. Termination does not affect:
- Payment obligations for services already provided
- Confidentiality obligations, which continue indefinitely
- Any provisions intended to survive termination
We reserve the right to terminate services immediately if you breach these terms or engage in conduct we deem inappropriate or harmful.
13. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved as follows:
- Informal Resolution: Parties agree to first attempt good-faith negotiations to resolve disputes
- Mediation: If informal resolution fails, parties may agree to mediation before pursuing other remedies
- Governing Law: These terms are governed by the laws of Singapore
- Jurisdiction: Any legal proceedings shall be conducted in the courts of Singapore
14. General Provisions
Entire Agreement: These terms, together with any service-specific agreements, constitute the entire agreement between parties and supersede all prior understandings.
Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
Assignment: You may not assign your rights or obligations under these terms without our written consent. We may assign our rights to any successor entity.
Notices: All notices shall be in writing and sent to the contact information provided. Notices are deemed received when delivered by email or three business days after posting by mail.
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes become effective upon posting to our website. Significant changes affecting existing service agreements will be communicated directly to clients. Continued use of our services after changes constitutes acceptance of the modified terms.
